Yesterday, on June 20th, Ingulsky (former Leninsky) district court of Nikolaev announced sentences to two “separatists”, having sentenced them to 5 years of prison. Three more participants of the so-called “group wanting to create the Nikolaev People’s Republic” also received similar sentences, but with probation periods.
This was reported by the press service of the SBU.
According to the department, they were sentenced according to Part 2 of Article 110 of the Criminal Code of Ukraine – “Willful actions committed to change the territorial boundaries or national borders of Ukraine in violation of the order provided for in the Constitution of Ukraine, and also public appeals or distribution of materials with appeals to commit any such actions – shall be punishable by restraint of liberty for a term up to three years, or imprisonment for the same term”. It should be noted that 5 years is the extreme ceiling under this article.
The investigation continued for nearly 2 years. On August 20th, 2015, the chairman of the SBU Vasily Gritsak reported that in Nikolaev region the activity of “separatists” was prevented, who allegedly, instigated by the special services of Russia, prepared in the region a number of specific actions on the eve of and during the celebration of the Independence Day of Ukraine – on August 24th. According to him, the “guilty” were going to distribute on the streets anti-State leaflets aimed at the overthrow of the constitutional system of Ukraine.
The SBU worked on a lead and arrested the suspects. Already on August 22nd the suspicion on Part 2 of Article 110 of the Criminal Code of Ukraine and the measure of restraint in the form of detention was announced.
In addition, during searches the employees of the special service found and confiscated a huge amount of ammunition stored in a visible place, and also an explosive device, grenades, and a MP-40 submachine gun. Also, anti-Ukrainian leaflets were found (apparently, those that they planned to distribute to Ukrainians), a certain book describing how it is best to conduct sabotage activity, and a list of local pro-Ukrainian activists, who, it appears, the weapon and ammunition were intended to be used against.
At the end of the investigative actions and hearings of the case in court proceeding, which, as was already mentioned, lasted almost 2 years, two “separatists”, one of which was a former police officer of Ukraine, were sentenced to 5 years of prison.
It is noteworthy that the sentence took place after the cancellation of “Savchenko’s law”, so, the days spent by the guys in the pre-trial detention center won’t be considered as 2 days of prison, therefore they will sit for a very long time. So, now, after the cancellation of the notorious bill, the sentences will be pronounced to “separatists” much quicker than earlier.
