Ukrainian Missile “Experiment”: The Line That Kiev Must Not Cross

entrenched in the leadership positions in Kiev assuredly conduct their affairs towards a final solution of the Ukrainian question.

While some of the Moscow thinkers, including State Duma deputies and other activists on duty, talk at length about the “bad behavior of Ukraine”, which decided to do some shooting of missiles over the Russian Crimea and call for an “objective and impartial position of the international community” that, between you and me, is enough to make a cat laugh, the Ministry of Defence of Russia expressed itself much more distinctly and, most importantly, in the legal plane. As was stated in the Russian Defense Ministry, the Southeastern border of the missile firing danger zone announced by Kiev violates the boundaries of the territorial sea of Russia and international law.

In order to understand the severity of the reaction of the Russian military, it is necessary to explain the meaning of some international legal terms and how they correspond to each other. Here we read from a legal reference book:

“The State border of the Russian Federation at sea is:

the external and lateral borders of the territorial sea, within which the Russian Federation implements its sovereignty in maritime waters (including its seabed and subsoil) and the airspace over them. Federal laws determine the width of the territorial sea at 12 nautical miles from the reference line. In the areas where the territorial sea of the Russian Federation meets with the territorial sea of a neighbouring state, the state border Russian Federation in navigational miles is established in accordance with bilateral (multilateral) international agreements with neighboring countries and is recorded in the protocols-descriptions of borders and the maps attached to them.”

Thus, it is quite obvious that the concept of “territorial sea” is absolutely equal to the concept of “territorial waters”, which in turn is equivalent to the concept of the state territory/waters of the Russian Federation. This, according to the Constitution, is inviolable:

Article 4
1. The sovereignty of the Russian Federation shall cover the whole of its territory…
3. The Russian Federation shall ensure the integrity and inviolability of its territory.

Taking into account this fact, and in case of attempts of the Kiev regime to violate the state sovereignty of the Russian Federation, especially with the use of the Armed Forces and related capabilities, every ground for abstract reasoning and politically correct discussions on this topic, not to mention quite childish appeals to the international community, automatically disappears. And it is the constitutional duty of the Armed Forces of the Russian Federation that enters into force by all means at their disposal to stop armed aggression and, thereby, to ensure the inviolability of Russian territory. Including through active actions on the neutralization of the corresponding firing means located on the adjacent areas.

Any other interpretation of this question in the framework of the Constitution is unacceptable and, in fact, is seen as an incitement to a state crime.

In this case, no reasoning of high policy and momentary political conjuncture, no matter how important they may seem to some salon policymakers and notorious commentators, must not be taken into account. The unpunishable and pre-meditated violation of the inviolability of the Russian borders by foreign Armed Forces will have disastrous consequences, such as the substantial degradation of the fundamental bases of the Russian statehood in terms of its sovereignty and territorial integrity. Moreover, the successfulness of such provocations will create the psychological ground for the continuation and expansion of such aggressive actions against Russia. First of all, because such behavior of the Russian side will definitely be evaluated by the external enemy as weakness and readiness for further concessions. Actually it is precisely in such a “gut check” that the main purpose of this militaristic “experiment” of Kiev and Washington can be concluded.

Thus, the moment of truth is approaching. There are limits beyond which political and diplomatic means of resolving issues are completely exhausted and the time comes to defend their interests by other means. And at this time we need to realize that if the enemies of Russia want war with her, they will continue to strengthen their provocations exactly until the moment they get the desired result. So in this respect – “the ball is in their court”, and Russia can only be well prepared to meet the inevitable. If they don’t want a big confrontation, but to only feel out the Russian resolve and try to exert political pressure, in this case a good hit on their teeth will not be excessive. Anyway, there will not be war in this case, due to the lack of corresponding political objectives. And Russia’s determination will be the main reason for this.
